Terms and Conditions (AGB)
1. Provider & Scope
These Terms and Conditions apply to the use of the PlayAce platform, operated by Ace Labs UG (haftungsbeschränkt).
Conflicting terms of users do not apply.
2. Service Description
PlayAce provides a digital software platform (SaaS) for organizing, managing, and networking activities related to tennis.
The specific scope of functions is determined by the current product description within the platform. PlayAce does not guarantee any specific success or availability of individual functions.
3. Registration & User Account
Use requires registration.
Information must be truthful.
User accounts are not transferable.
PlayAce is entitled to block or delete user accounts at its reasonable discretion, particularly in cases of
- Violations of these Terms and Conditions
- Illegal use
- Abuse or manipulation of the platform
A prior warning will be issued where reasonable.
4. User Obligations
Users may not misuse the platform.
In particular, the following are prohibited
- Illegal content
- Misleading club or identity information
- Circumvention of technical protection measures
- Disruption of the platform or other users
5. Community Clubs & Third-Party Content
Community clubs and groups can be created independently by users and are not necessarily connected to real clubs or organizations.
PlayAce
- does not act as a representative of real clubs
- takes no responsibility for user content
- removes content or designations immediately if third-party rights (e.g., trademark or name rights) are asserted
6. Beta Features
Individual features may be offered as beta.
Beta features may
- be faulty or incomplete
- be changed or discontinued
- lose data
There is no claim to permanent availability or further development.
7. Availability
PlayAce strives for the highest possible availability but does not guarantee continuous or uninterrupted use.
Maintenance, updates, or technical disruptions may lead to temporary restrictions.
8. Liability
PlayAce is liable without limitation in cases of
- Intent
- Gross negligence
- Violation of life, body, or health
In cases of simple negligence, PlayAce is only liable for violation of essential contractual obligations and limited to typically foreseeable damage.
Liability for
- lost profit
- indirect damages
- data loss
is excluded to the extent legally permissible.
9. Term & Termination
Use of the platform can be terminated at any time, provided there is no separate paid agreement.
Paid services are regulated separately.
10. Changes to the Terms and Conditions
PlayAce is entitled to change or supplement these Terms and Conditions if there is a material reason, particularly in cases of
- legal or regulatory changes,
- platform development,
- adjustment of the scope of services,
changes in market or usage conditions.
Users will be informed of material changes in a timely manner in text form (e.g., by email or in-app notice).
If the user does not object to the changes within 14 days of receipt of the notice, the changes are deemed accepted.
The user will be expressly informed of the right to object in the change notice.
If the user objects in a timely manner, PlayAce is entitled to terminate the user relationship at the time the changes take effect.
11. Final Provisions
German law applies.
For consumers, the statutory place of jurisdiction applies.
For entrepreneurs, the place of jurisdiction is the seat of PlayAce.
Should individual provisions be invalid, the validity of the remaining regulations remains unaffected.
